Allahabad HC rejects Rahul Gandhi's plea in Sikh remarks case

The Allahabad High Court on Friday dismissed a revision petition filed by Congress MP and Leader of the Opposition in the Lok Sabha, Rahul Gandhi, challenging the order of the MP/MLA Special Court in Varanasi.

The case relates to the statement made by him regarding Sikhs in the United States. Rahul Gandhi had challenged the order of the Special MP/MLA Court in Varanasi, which had accepted the petition filed against him. Following the High Court's decision, the case will now proceed to the MP/MLA Court in Varanasi.

The issue started when Nageshwar Mishra filed a complaint in a Varanasi court. He claimed that Gandhi, during a visit to the United States in September 2024, made a “provocative” comment questioning whether Sikhs in India feel safe wearing turbans or visiting gurdwaras. Mishra said the statement could disturb communal harmony.

The magistrate court first dismissed the plea, saying the alleged remarks were made outside India and therefore required sanction from the Central government to proceed. Mishra then went to the Sessions Court, which overturned the dismissal and asked the lower court to hear the case again.

Rahul Gandhi challenged the Sessions Court’s order in the Allahabad High Court. His lawyer argued that the remarks were taken out of context and that Gandhi had not incited rebellion or violence.

“You cannot pick a single line from a speech and twist its meaning,” the counsel told the court.

The Uttar Pradesh government’s lawyer argued that Gandhi, being the Leader of the Opposition, has a responsibility for his words.

The controversy is linked to Gandhi’s speech in the US, where he reportedly claimed that the atmosphere in India was not friendly towards Sikhs.

After hearing both sides, the High Court reserved its order and directed the Varanasi court to wait until its decision is delivered.
